Terms of Service

Welcome to YouBots.ai. These Terms of Service (the “Terms”) govern your access to and use of YouBots.ai’s platform and services. By using our services, you agree to these Terms in full. If you do not agree to any part of these Terms, you must not use the platform.

1. Services Provided

Platform Access:

  • YouBots.ai provides access to its suite of AI-powered assistants (“YouBots”) to enhance productivity and streamline workflows for its users.

Human-in-the-Loop Tools:

  • YouBots.ai tools are designed as “human-in-the-loop” tools. They are not capable of integrating with your internal systems, nor can they post anything online or take actions on your behalf.
  • Any implementation of recommendations or external communications must always be performed by your team. YouBots.ai disclaims all liability for actions taken after using our tools. Please note that AI tools can sometimes make mistakes, and it is your responsibility to verify data and ensure all actions align with your organization’s goals and standards.

2. Subscription Terms

Subscription Plan:

  • Users will subscribe to their chosen plan and rate via the YouBots.ai website and payment platform.
  • The $1,000/month plan includes up to 5 simultaneous active users. The $2,000/month plan includes up to 25 simultaneous active users. An active user is defined as someone logged into and using the platform within a 5-minute period.

Usage Limits:

  • Active sessions and the number of simultaneous users are logged to ensure equitable usage. YouBots.ai implements systems to optimize concurrency and save costs for users.
  • A Fair Use Policy applies to all monthly plans. YouBots reserves the right to limit your usage or suspend your service if your actual monthly usage greatly exceeds average customer usage.

Payment Terms:

  • Payments are due monthly in advance through a recurring subscription and must be made by credit card.
  • Late payments may result in suspension of services until the account is brought current.

3. Onboarding and Support

Onboarding Process:

  • Users agree to complete the intake process through IntakeBot to establish their organizational profile.
  • Accurate and comprehensive intake information is necessary for optimal platform customization.

Support Services:

  • Users will have access to HelpBot for troubleshooting and guided support. HelpBot can create support tickets to submit to the support team.
  • Users may also email “support@youbots.ai” if HelpBot cannot resolve the issue.

4. Confidentiality and Data Security

Confidentiality:

  • YouBots.ai will maintain strict confidentiality regarding users’ data and proprietary information.
  • Users agree to maintain strict confidentiality regarding YouBots.ai’s proprietary information and technology and shall not disclose such information to any third party without prior written consent.

Data Security:

  • The platform employs industry-standard encryption and security protocols to protect user data.
  • YouBots.ai shall not disclose user data to any third party without prior consent, except when legally compelled to do so.

Intellectual Property:

  • Any content, materials, or intellectual property created by users while using the YouBots.ai platform remains the sole property of the user.
  • YouBots.ai makes no claim to ownership of any user-generated content or intellectual property created through its tools.
  • It is the user’s responsibility to ensure compliance with applicable laws and intellectual property rights when using the platform.

Jurisdictional Constraints:

  • YouBots.ai services are primarily designed for users within the United States and may not be fully operational or available in jurisdictions outside the U.S. due to GDPR and other international compliance requirements.

5. Termination and Refund Policy

Termination by Users:

  • Users may terminate their use of the platform at any time by canceling their subscription through the website.

Termination by YouBots.ai:

  • YouBots.ai reserves the right to terminate access to the platform if users breach these Terms or fail to make payments.

Refunds:

  • Refunds for unused portions of a subscription period are not provided unless required by law.

6. Limitation of Liability

Scope of Liability:

  • YouBots.ai’s tools are advisory in nature and require human oversight. The Company disclaims all liability for any actions taken by users or their employees after using the platform.
  • The platform is provided “as is,” and YouBots.ai makes no warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose.

7. Prohibited Activities

Users shall not, and shall not permit or enable others to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, techniques, algorithms, or processes of the platform.
  • Attempt to bypass or breach any security mechanism or access unauthorized portions of the platform.
  • Engage in any activity that disrupts or interferes with the platform, including but not limited to denial of service attacks, excessive API calls, automated scraping, or load testing without prior written authorization.
  • Copy, modify, create derivative works, sublicense, transfer, distribute, frame, or mirror any part of the platform.
  • Access or use the platform to build a similar or competitive product or service.
  • Use the platform in any manner that violates applicable laws or regulations, infringes on intellectual property rights, or violates the rights of any third party.
  • Transmit malware, viruses, or any code of a destructive nature through the platform.
  • Attempt to gain unauthorized access to other users’ accounts or their related data.
  • Use the platform in any way that could damage, disable, overburden, or impair YouBots.ai’s servers or networks.

Violations of these restrictions may result in immediate termination of access to the platform and potential legal action.

8. Amendments

  • YouBots.ai reserves the right to update or modify these Terms of Service at any time.
  • Users will be notified of any changes via email at least once every six months, with a link to the updated Terms.
  • Continued use of the platform after notification constitutes acceptance of the updated Terms.
  • Users are encouraged to review the Terms regularly to stay informed of any updates.

9. Acknowledgment

By using YouBots.ai’s platform, you acknowledge that you have read and understood these Terms of Service and agree to comply with them.
